PurpleHoney Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the PurpleHoney mobile application (the “App”) and the website purplehoneyapp.com (the “Website”), which are operated by SecondSurfer LLC (“SecondSurfer”, “we”, “us”, or “our”).

By accessing or using the App or Website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use PurpleHoney.

1. Eligibility

PurpleHoney is intended for adults. By using the App or Website, you represent and warrant that:

• You are at least 18 years old (or the age of majority in your jurisdiction, if higher); and
• You have the legal capacity and authority to enter into these Terms.

You may not use PurpleHoney if you are under 18 or if use of the service is prohibited by the laws of your jurisdiction.

2. Our Service

PurpleHoney is a relationship wellness product designed for couples. The App and Website help you and your partner:

• Explore relationship and intimacy-related preferences and desires in an anonymous way;
• Play games and challenges aimed at improving communication and connection; and
• View high-level, anonymized statistics about how other couples engage with similar content.

We may modify, update, or discontinue any part of the App or Website at any time, with or without notice. We are not liable to you or any third party for any such modifications, updates, or discontinuation.

3. Anonymity and Accounts

The App is designed to be used anonymously. We do not require you to provide your real name, email address, or other directly identifying information to use the App.

Within the App:

• Couples are represented by a randomly generated couple name or identifier, which is used for in-app features such as scoring, games, and leaderboards.
• Relationship and preference data you provide is tied only to this anonymous couple identifier, not to your real-world identity.

If we introduce optional account features in the future (for example, optional accounts linked to email), such features may be subject to additional terms or notices.

4. Website Email Collection

On the Website, you may choose to provide an email address so that we can:

• Send you a Relationship Wellness Report or Starter Kit based on your responses; and/or
• Notify you about app releases, updates, or promotional codes (for example, potential free lifetime access).

By submitting your email on the Website, you consent to receiving such communications. You can unsubscribe at any time using the mechanisms provided in our messages or by contacting us.

Emails collected on the Website are stored separately from the anonymous in-app data and are handled in accordance with our Privacy Policy.

5. User Content and Responsibilities

The App may allow you and your partner to share responses, preferences, and other relationship or intimacy-related information (“User Content”). You are solely responsible for the User Content you submit.

By using PurpleHoney, you agree that you will:

• Only submit content that is lawful in your jurisdiction;
• Only use PurpleHoney for personal, non-commercial relationship wellness purposes;
• Respect your partner’s boundaries and consent in all activities, discussions, and challenges triggered by the App; and
• Not use PurpleHoney to harass, abuse, threaten, or harm anyone.

6. Prohibited Use

You agree that you will not:

• Use PurpleHoney in any way that violates any applicable law or regulation;
• Submit or share content that exploits, sexualizes, or depicts minors;
• Submit or share content that is violent, hateful, or that promotes discrimination or harm;
• Attempt to de-anonymize or identify other users or couples from aggregated statistics or in-app features;
• Reverse engineer, decompile, or attempt to derive the source code of the App except to the extent allowed by law;
• Interfere with the operation of the App or Website, including by introducing malware, bots, or automated scripts not authorized by us;
• Use PurpleHoney to send unsolicited commercial communications or spam; or
• Use PurpleHoney in any way that we reasonably consider to be misuse of the service.

7. Intellectual Property

All content and materials in the App and Website, including but not limited to text, graphics, logos, icons, images, user interface, design, and software, are owned by or licensed to SecondSurfer LLC and are protected by intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App and Website for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the App or Website except as expressly permitted by these Terms or with our prior written consent.

8. Anonymous Data and Aggregated Insights

We may use anonymous, aggregated data derived from App usage (for example, how many couples selected a certain option or completed a certain challenge) to:

• Provide in-app statistics and insights;
• Improve the App and Website; and
• Inform our product and content roadmap.

Such data does not identify individual users or couples and is handled in line with our Privacy Policy.

9. Third-Party Services

The App and Website may use or link to third-party services, such as analytics tools, email providers, app stores, or social media platforms. These third parties are independent of SecondSurfer and have their own terms of service and privacy policies.

We are not responsible for the content, policies, or practices of any third-party services. Your use of such services is at your own risk and subject to the terms and policies of those third parties.

10. No Professional Advice

PurpleHoney is a relationship wellness and entertainment product. It does not provide medical, psychological, psychiatric, legal, or financial advice, and is not a substitute for professional counseling, therapy, or other professional services.

You are solely responsible for decisions you make in your relationship. If you need professional advice or support, you should consult a qualified professional.

11. Disclaimers

The App and Website are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• Any warranties that the App or Website will be uninterrupted, error-free, secure, or free of harmful components;
• Any warranties regarding the accuracy, completeness, or usefulness of any content or insights.

12. Limitation of Liability

To the maximum extent permitted by law, SecondSurfer LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, or emotional distress, arising out of or in connection with your use of or inability to use the App or Website.

In no event will our total liability to you for all claims relating to the service exceed the greater of:

• The amount you paid (if any) for access to the App in the 12 months before the event giving rise to the claim; or
• One hundred U.S. dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless SecondSurfer LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

• Your access to or use of the App or Website;
• Your violation of these Terms; or
• Your User Content or misuse of PurpleHoney.

14. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to them or your use of PurpleHoney will be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

Any dispute arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of such courts.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page.

If we make material changes, we may notify you via the Website, in the App, or by email (where appropriate). Your continued use of the App or Website after the updated Terms are posted means you accept the changes.
